The online store Tallinn Zouk is operated by OÜ Triinabra (registration code 16941733), located at Hommiku tn 7, Tallinn, 10919.
Validity of the Sales Contract, Product and Price Information
The terms of sale apply to purchases of goods and services from the Online Store.
The prices of goods and services sold in the Online Store are indicated next to the goods and services. A delivery fee is added to the price of certain goods. All prices of products sold in the Online Store are in euros.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order. Information about the product is provided in the Online Store directly next to the product.
Order Processing
To order goods and services, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:
- Estonian bank payments
- Finnish bank payments
- Latvian bank payments
- Lithuanian bank payments
- Visa / Mastercard card payments
- Apple Pay and Google Pay
NB! When paying via bank link, be sure to click the “Return to merchant” button on the bank page.
Payments are mediated by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment — when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank and credit card details.
The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorised processor Maksekeskus AS.
The contract enters into force upon receipt of the amount due to be paid to the Online Store’s current account.
If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than within 14 days of sending the notification.
Delivery
Most of the products sold in the Online Store are services and their orders are generally fulfilled electronically, without physically sending the goods to the customer. Physical goods (gift cards, souvenirs, etc.) are shipped within Estonia.
The buyer bears the shipping costs of the goods and the corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally arrive at the destination specified by the buyer within 3–7 working days from the entry into force of the sales contract. Delivery outside Estonia is only possible by prior special agreement. In exceptional cases, the goods may be delivered within up to 45 calendar days.
Cancellation of Tickets and Event Registrations
Tickets and registrations for festivals, parties, courses, workshops and other events sold through the online store are contracts for the provision of leisure services on a specific date or during a specific period. Pursuant to § 53 (4) 7) of the Law of Obligations Act, the right of withdrawal does not apply to such contracts, and the buyer accordingly has no statutory right to withdraw from them within fourteen days. In place of the right of withdrawal, the online store grants the buyer the options set out in this clause.
Before the event, changes to passes are possible as follows:
- Cancellation with refund — the ticket is cancelled and the fees paid for it are refunded, less an administration fee of €25 per ticket. The request must reach the online store no later than one month before the first day of the event.
- Transfer to the following edition — the ticket is transferred to the next year’s edition of the same event, against an administration fee of €15 per ticket. The request must reach the online store no later than the Monday falling two weeks before the first day of the event.
- Change of name — the ticket is transferred to another person for the same year’s edition of the event, free of charge. The request must reach the online store no later than the last Monday before the first day of the event. Finding the new ticket holder and agreeing the terms of the transfer between them, including any payment for the ticket, is the responsibility of the ticket holder; the online store only carries out the change of name.
To exercise one of the above options, the buyer must submit a request in free form to info@tallinnzouk.ee, stating the order number, the ticket concerned and the option chosen. In the case of a change of name, the request must also state the name and contact details of the new ticket holder. The request must reach the online store by the deadline laid down above for the option chosen; requests received thereafter, and tickets left unused, do not give rise to a refund, a transfer or a change of name.
Where fewer than three days remain before the first day of the event, the place can no longer be offered to another participant, and cancellation, transfer and change of name are accordingly no longer possible. The buyer is nevertheless asked to notify the online store that they will not be attending; buyers who do so are given priority and a discount in respect of the following edition of the event.
The administration fee is withheld from the amount refunded or, where no amount is refunded, is payable before the change takes effect. Where a ticket was bought at a discounted or promotional price, the refund is calculated on the price actually paid. Where several tickets were bought in a single order, the fee applies to each ticket separately.
The online store refunds the amount due promptly, but no later than within 14 days of accepting the request, using the same means of payment by which the payment was made, unless the buyer has expressly agreed otherwise.
A ticket transferred to the following year’s edition is valid only for that edition. It may thereafter be subject to a change of name in accordance with this clause, but it may not be transferred to a further edition or cancelled with a refund.
If the event is cancelled by the online store, or postponed to a date on which the buyer is unable to attend, all fees paid for the ticket are refunded and no administration fee is withheld.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days, provided that the goods/services have not been consumed. The right of withdrawal does not apply if the buyer is a legal entity, nor does it apply to tickets and event registrations, which are governed by the clause “Cancellation of Tickets and Event Registrations” above.
To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for a purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in value of the goods.
To return the goods or cancel the service, you must submit a free-form withdrawal form and send it to the e-mail address info@tallinnzouk.ee no later than 14 days after receiving the goods or paying for the service.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to the order (e.g. an incorrect or defective product).
The buyer must return the goods within 14 days of submitting the application or provide proof that he or she has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the online store will immediately refund to the buyer, but no later than 14 days after receipt of the withdrawal form, all fees received from the buyer under the contract.
The online store may refuse to issue refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence that they have returned the item, whichever occurs first.
If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the consumer any costs that exceed the costs associated with the standard delivery method.
The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.
Right to File a Claim
The Online Store is liable for any non-conformity or defect of the goods sold to the Buyer that already existed at the time of delivery of the goods and that becomes apparent within two years of the delivery of the goods to the Buyer. Within this 1 year from the delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery of the goods. It is the Online Store’s obligation to rebut this presumption.
The buyer has the right to contact the online store within two months of discovering a defect by sending an e-mail to info@tallinnzouk.ee or calling +372 5787 5991.
The online store is not responsible for defects that have arisen after the goods have been delivered to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer.
The online store will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transfers personal data to companies providing transportation services in order to deliver the goods.
The online store will send newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a desire to do so by entering their e-mail address on the website and has indicated their desire to receive direct mail notifications. The buyer can opt out of offers and newsletters sent to e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent by e-mail to info@tallinnzouk.ee or calling +372 5787 5991.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the Commission is free of charge.
The buyer may contact the European Union’s consumer dispute resolution platform.
